Avajin v. Weast New 4th Circuit (unpublished, non-binding) Opinion
I just learned of this newly released local case invovling special ed and due process appeal. The case rules against the parents seeking reimbursement for a residential placement of their son. The bottom line: Unless the written IEP expressly provides for the residential placement, a parent can’t get the school district to pay for it, no matter what was said during the IEP meeting by the school team. If a service, accomidation, placement or the like isn’t written down and seen within the four corners of the IEP, parents face an uphill battle when it comes to enforcement.
